Book Description
فقه المعاملات هو الفقه الذي ينظم العلاقة المالية بين أفراد المجتمع، ويوضح لهم المعاملات المشروعة، وغير المشروعة، الغاية منه أن يكون المسلم على بيّنة من أمره في تعاملاته المالية، وفي بيعه وشرائه.
وهذا الكتاب يبحث في "فقه المعاملات المالية وأدلته عند المالكية" أي انه تم التركيز فيه على المذهب المالكي "مالك بن أنس الأصبحي" المتوفى سنة (179هـ)، وهو الذي قال عنه شيخ الإسلام ابن تيمية: "فأصول مالك في البيوع اجود من أصول غيره، فإنه أخذ ذلك عن سعيد بن المسيب الذي كان يقال هو أفقه الناس في البيوع".
من هنا، تأتي أهمية هذا الكتاب الذي أراد مؤلفاه أن يضيفا لبنة أساسية إلى المكتبة العربية والإسلامية، تسهم في بناء صرح "فقه المعاملات"، وفق المذهب المالكي، ولا سيما أن الناس يجدون صعوبة كبرى في فهمه، وذلك لعدم تعامل الناس به في واقعهم المعيش من جهة، وكذاك صعوبة تناوله في كتب الفقه المالكي مباشرة من جهة أخرى، إذ أن هذه المؤلفات تمتاز بغموض العبارة وعدم التبسيط في العرض، مما يجعل الدارس لها أول وهلة، وكأنه يتعامل مع طلاسم.
من هنا، أراد مؤلفا الكتاب أن يقدما للقارئ المسلم هذا الففه الخاص بــ (المعاملات) بعد ما أخرجاه من بطون الكتب وشرحاه بعبارات سهلة، سلسلة، تتماشى مع مختلف المستويات، أما من الناحية البحثية (المنهجية)، فقد تناول المؤلفان كل مسألة على شكل نقاط متعرضين فيها للتعريف بشقيه اللغوي والإصطلاحي، ثم الحكم وأدلة المشروعية، والحكمة، والأركان والشروط، ثم ختماها بالمسائل المتفرقة المتعلقة بكل مسألة ومنها مسائل جديدة معاصرة، كمسألة: بدل الخلو في الإجارة، وطلب الشفعة عن طريق الهاتف، أو الفاكس، والتطبيقات المعاصرة لعقد المسلم، وزكاة أسهم الشركات، وأحكام النقود الورقية وتغير قيمة العملة، وغيرها من المسائل المبثوثة في ثنايا هذا الكتاب.
ويبقى أن نشير إلى أن هذا الكتاب هو "البحث الفائز بالجائزة الوطنية الأولى لمسابقة الفقه المالكي التي تنظمها وتشرف عليها مديرية الشؤون الدينية والأوقاف لولاية تبسة - الجزائر".
