إن الحق في البناء هو أحد أوجه حق ملكية الأرض، وأن حق الملكية قد تكفل الدستور بحمايته وضمانه، فالأصل أن للمالك الحرية في استعمال ملكيته العقارية واستغلالها والتصرف فيها؛ وكذا ممارسة جميع الأنشطة العمرانية التي يراها تحقق مصلحته الخاصة؛ ومن باب أولى الحق في البناء. في المقابل إن هذه الحرية مقيدة بأن لا تتعارض مع الصالح العام والنظام العام العمراني، حيث أن حفظ النظام العام يمنع انتشار المخالفات والجرائم في هذا المجال، ويسعى إلى حماية الصحة العامة بمنع انتشار الأوبئة وقطع السبل أمام الأسباب المؤدية إلى ذلك، وإلى تحقيق السكينة العمومية بمنع انتشار الضوضاء والفوضى؛ ومنها فوضى البناء والأحياء العشوائية.
