إذا كان الاختصاص الأصيل لمأمور الضبط القضائي ينحصر في أعمال الاستدلال، فإنه قد منح- بصفة استثنائية بموجب القانون- الحق في القيام ببعض الإجراءات التي تختص بمباشرتها أصلًا سلطة التحقيق، والتي فيها مساس بحريات الأفراد وحرماتهم كالقبض والتفتيش، وذلك في حالة التلبس بالجريمة. وهذا الاختصاص استثنائي بحت.
وقد راعى المشرع في هذا الاستثناء اعتبارين: الأول هو المحافظة على أدلة الجريمة من الضياع، والثاني تكون في حالة التلبس بالجريمة. ولذلك إذا وقعت جريمة بيئية على مرأى من مأمور الضبط القضائي فشهدها بنفسه، أو حين تكون أدلتها الظاهرة شاهدة عليها، فيجب عليه التدخل على وجه السرعة حتى لا تضيع معالمها أو تمتد إليها يد التلفيق فتطمسها انتظارًا لانتقال سلطة التحقيق إلى موقع الحادث.
وسوف نقتصر في هذا الكتاب على تناول خصوصية الضبط القضائي، ثم إلقاء الضوء على اختصاصات وسلطات مأموري الضبط القضائي في الجرائم البيئية؛ تاركين إجراءات الضبط القضائي المتمثلة في وقاعد التلبس بالجريمة وإجراءات القبض والتفتيش للقواعد العامة؛ إذ إن إثبات معظم الجرائم البيئية لا تتم عن طريق حالة التلبس الذي يبيح القبض على المتهم وتفتيشه، بل تتطلب لإثباتها وجود بعض الأجهزة لقياس نسبة التلوث في التربة أو الهواء أو الماء فضلًا عن مجموعة من الإجراءات التي سوف نتناولها بالتفصيل في هذا الكتاب.
