سئل المؤلف كثيرا عن معني وماهية الفقه المقارن وكان قد ذكره في سياق حديثه في كتب أخري نشرت له فرأي ان يؤلف هذا الكتاب عن الفقه المقارن وعن موضوع ألمقارنه ومصادر الفقه الإسلامي ونشأة المذاهب ألفقهيه ثم انتقل للحديث عن نشأة ألمقارنه والاجتهاد والتقليد والتلفيق ثم ذكر فائدة الفقه المقارن وافرد بعدها جزءا كبيرا من الكتاب يذكر فيه أهم أسباب اختلاف الفقهاء اللفظ والرواية والتعارض والعرف و الادله المختلفة .
