دراسة علمية تشق طريقها فى جعل المصلحة المرسلة داخل منظومة النصوص الشرعية الجزئية والكلية ، مع مناقشة مستفيضة لشبهات من يرى أن المصلحة المرسلة تقدم على النص والإجماع، وان هناك تعارضا حقيقيا بين المصلحة والنص أحياناً وان الصاحبة خالفوا النصوص للمصلحة هذا مع مناقشة لتيار أخر يرى عدم الحاجة إلى العلم بالمصلحة المرسلة لكفاية النصوص والخوف من احتواء علماء السوء فلا يعمل بالمصلحة احتياطاً وهو اتجاه يجر واسعا ويجعل الشريعة قاصرة عن مواكبة المستجدات، هذا مع مناقشة الضوابط الشرعية للعمل بالمصلحة حتى يكون نسيج النصوص والمصلحة المرسلة معاً ثوابا متناسقا فى تغطية وكسوة جميع المستجدات بالحنيفية السمحاء وليس بإتباع الأهواء، وقد تضمنت الدراسة أيضا أمثلة من تاريخنا الفقهي وواقعنا الحالي مصدرها العمل بالمصالح المرسلة.
