لقد ساد المبدأ القائل بعدم جواز التصرف بالمال العام لزمن طويل في منظومة القانون العام الفرنسي، وتم نقل هذا المبدأ من فرنسا إلى التشريعات العربية، وكان أحد النتائج الكبرى لهذا المبدأ عدم جواز التصرف بالمال العام، وحظر أثقاله بحقوق العينية لمصلحة الغير بشكل مطلق.
وتأسس هذا المبدأ على شرعية تاريخية في فرنسا حيث تعود بداياته إلى العهد الملكي في القرن الرابع عشر الميلادي، حيث تمثل دوره الوظيفي في حماية أموال التاج، ثم تطور هذا الدور ليصبح حماية أموال الأمرة بعد الثورة الفرنسية، ثم تحول هذا الدور الوظيفي ليصبح حماية الأموال المخصصة لسير المرافق العامة.
وطبق مجلس الدولة الفرنسي هذا المبدأ بشكل جامد، مما أدى إلى نتائج قانونية هامة، ونتيجة إقتصادية تتمثل في تجاهل القيمة الإقتصادية للمال العام، والذي يمثل ثروة هائلة، إلا أنها ظلت على الدوام بعيدة عن عملية التنمية العامة.
إلا أن هذا الوضع لم يدم في الوقت الحالي حيث تعالت الأصوات الفقهية من أجل الحد من جمود هذا المبدأ، بل طالب البعض بإلغائه، من أجل إدماج المال العام في عملية التنمية والإستثمار، وعدم بقائه قيمة إقتصادية معطلة، وذلك كله على أرضية دستورية ناجمة عن تدخل تاريخي للمجلس الدستوري الفرنسي، وإستناداً إلى المناخ القانوني الأوروبي الذي كانت له مؤثرات واضحة على القانون الفرنسي في هذا المجال، وهو ما ممهد لتدخل المشرع الفرنسي لأول مرة ليبيح بعض أوجه التصرف بالمال العام، وزجه في عملية التنمية.
في حين ما زالت التشريعات العربية بعيدة إلى حد كبير عن هذه الفلسفة القانونية الجديدة للمال العام.
