سنعرض فى هذا الكتاب لفكرة حسن النية فى المعاملات المدنية، ولمواجهة المشرع والقضاء للغش وتلك الفكرة وإن كانت من حيث الأصل هى فكرة أخلاقية إلا أن المشرع لم يفرغ نظرية عامة لمواجهتها ووضع لها العديد من التطبيقات التشريعية كما أن القضاء قد أرسى العديد من التطبيقات القضائية في هذا الصدد.
ويؤخذ بعين الاعتبار أن فكرة الغش هي الوجه المضاد لفكرة حسن النية التى يجب أن تسود كافة المعاملات، فقاعدة الغش يفسد التصرفات هي قاعدة قانونية سليمة ولو لم يجربها نص خاص فى القانون وتقوم على اعتبارات خلقية واجتماعية فى محاربة الغش والخديعة والاحتيال وعدم الانحراف عن جادة حسن النية الواجب توافرها في التعاقدات والتصرفات والإجراءات عموماً صيانة لمصلحة الأفراد والجماعات.
وسنعرض لهذه الفكرة بالشرح النظري وتطبيقاتها في نطاق العقود وحق الملكية والحقوق العينية الأصلية والتبعية وسنقسم هذا الكتاب للعديد من الفصول مع عرض لما استقرت عليه أحكام محكمة النقض المصرية ومحكمة التمييز الكويتية كلما تسنى المقام لذلك.
