هذا التصوير الخاطئ للأصول القضائية ناتج عن الشك وإنكار فائدة وأهمية قانون أصول المحاكمات المدنية، فأصول المحاكمات المدنية لا تشكل مجرد إجراءً مادياً أو تطبيقاً للقواعد القانونية على النزاع المعروض على القضاء للبت فيه، فأصول المحاكمات المدنية هو فرع من فروع القانون الخاص وهو بالأحرى علم من العلوم القانونية الذي يساهم بتقدمه وتطوره بتطوير القانون والمجتمع ويسهل على المواطنين وأصحاب الحقوق مراجعة القضاء بأقل كلفة وأقصر وقت للمطالبة بحقوقهم وترسيخ العدالة الإجتماعية.
يتألف قانون أصول المحاكمات المدنية من 1033 مادة مقسمة إلى ثلاثة كتب، تناول المشرع اللبناني في الكتاب الأول، أصول المحاكمات، أما في الكتاب الثاني فقد تطرق إلى الخصومات وإجراءات متنوعة، وخصص الكتاب الثالث لدراسة التنفيذ، وفي هذا الكتاب دراسة أهم هذه الموضوعات التي تم توزيعها على ستة أبواب: الباب الأول: "الدعوى"، الباب الثاني: "الإختصاص"، الباب الثالث: "الإثبات"، الباب الرابع: "المحاكمة"، الباب الخامس: "الأحكام"، الباب السادس: "طرق الطعن".
