لقد كان لانتشار ظاهرة الإشكالات في تنفيذ الأحكام الإدارية وإساءة استعمالها بغير ضوابط أو قيود أن حادت الإشكالات في التنفيذ عن هدفها الأساسي كوسيلة شرعها القانون لتجنب مغبة التنفيذ الباطل للأحكام القضائية وأصبحت مجرد وسيلة لتعطيل تنفيذها خصوصًا من جانب الجهات الإدارية التي يفترض فيها أنها خصم شريف في المنازعات الإدارية ولا تبغي من وراء تصرفاتها سوى تحقيق المصلحة العامة.
مما يبين لنا مدى الحاجة إلى ضرورة تناولها بالبحث والدراسة للوقوف على مدى ملاءمتها لطبيعة المنازعات الإدارية خاصة في ظل غياب تنظيم تشريعي لها في مجال القانون الإداري، ومن ثم فإن دراستنا لإشكالات التنفيذ في الأحكام الإدارية وإلى أن يقوم المشرع بوضع هذا التنظيم سوف نعتمد بصفة أساسية على الأحكام المقررة لها من قانون المرافعات المدنية والتجارية وكذلك في ضوء الأحكام القضائية الصادرة عن محاكم القضاء العادي أو القضاء الإداري.
وعلى ضوء الاعتبارات المتقدمة سوف تكون دراستنا لإشكالات التنفيذ في الأحكام الإدارية على النحو التالي: الفصل الأول ونعرض فيه لماهية إشكالات التنفيذ، الفصل الثاني ونخصصه لتحديد نطاق الإشكالات في تنفيذ الأحكام الإدارية.
