من القواعد المشهورة في باب الرسائل: (ما حرم سدًا للذريعة أبيح للمصلحة الراجحة)، وقد أكثر شيخ الإسلام ابن تيمية وتلميذه ابن القيم من الاستدلال بها والتخريج عليها، ولا غرو؛ فهما من رؤوس الفقه المقاصدي الذين أتيح لهم من شفوف الرأي، وجودة النظر، في حكم التشريع وأسراره ما لم يتح لغيرهم.
أما المعاصرون فلم يفردوا القاعدة بدراسة مستقلة تعني باستنطاق محتواها، واستجلاء صلتها بالأصول التشريعية، وبيان تطبيقاتها الفقهية.
وما وقفت عليه من كلامهم في هذا الباب لا يعدو قبسة العجلان أو حسوة الطائر!
وقد حدا بي هذا الإعواز والخصائص حدوا إلى أفراد القاعدة بدراسة مستقلة تعني باستنطاق محتواها، وسوق أدلتها، وتبين علائقها، وتخريج الفروع عليها، فاستقامت- أي الدراسة- في ستة مباحث: الأول عني بشرح ألفاظ القاعدة وبيان صيغها عند الإمامين ابن تيمية وابن القيم، الثاني عني بإبراز المعنى الإجمالي للقاعدة، واستجلاء أبعاده المقاصدية، الثالث عني بسوق أدلة القاعدة من الكتاب والسنة والمعقول، تعضيدًا لمنحاها، وشدًا لنطاقها، الرابع عني باستيضاح علائق القاعدة بالأدلة والقواعد التشريعية كالمقاصد والمصالح واعتبار المآل والاحتياط، الخامس عني باستجلاء الفروق بين القاعدة والنظرية المكيافلية المتهافتة، السادس عني ببيان تطبيقات القاعدة عند الفقهاء، مع التخريج عليها في الواقع المعاصر.
وإذا كان لهذه الدراسة من فضل وعائد، فمن الإنصاف عزوه إلى الإمامين الجليلين: شيخ الإسلام ابن تيمية، وتلميذه ابن القيم؛ إذ قاما على تأصيل القاعدة أتم القيام، مع السبق المحمود، والأثر الحسن، وإن كنت لا أبخس عملي حقه، فقد رتبت فيه وهذبت، وأضفت مباحث أصيلة لعلي لم أسبق إليها، وهي تزيد القاعدة قوة وجلاء، وتضع لبنة في صرح فقه الوسائل.
