إن هذا البحث يتناول موضوعاً مهماً من موضوعات الشريعة الإسلامية ألا وهو الفقه المقارن، والذي يتمثل في تحقيق كتاب من أهم الكتب التراثية القديمة، وهو كتاب: المختصر الصغير للإمام عبد الله بن عبد الحكم المصري، من تلاميذ الإمام مالك "رحمه الله" وأحد أهم الشخصيات الفقهية البارزة في مصر، والذي عاش في منتصف القرن الثاني إلى أوائل القرن الثالث الهجري، كما يعد كتابه هذا من أوائل الكتب المؤلفة في المذهب المالكي، والذي يأتي في المرتبة الثالثة بعد الموطأ والمدونة، إلا أن الكتاب ظل محبوساً في خزائن المخطوطات البعيدة، مما جعل كثيراً من العلماء والباحثين يعتبرونه من التراث المفقود - كشأن كثير من المخطوطات الإسلامية المهمة - فلم يصل إلينا هذا الكتاب إلا مؤخراً، ولعل هذه الدراسة التي تقدم اليوم هي أول محاولة لكشف النقاب عن هذا الكتاب الأصيل الذي عز وجود أصله المخطوط، وبعد فقد اشتمل هذا البحث على مقدمة وفصلين وخاتمة، فالمقدمة فيها بيان خطة البحث وأسباب اختيار الموضوع، وأما الفصل الأول، وهو قسم الدراسة، وأما الفصل الثاني، وهو قسم التحقيق فقد استطرد فيه الباحث إخراج نص الكتاب إخراجاً سليماً ثم تحقيقه وضبط مسائله.
