Book Description
Jafar Jbn Hasan est né en 602 de l’Hégire à Hilla en Iraq. Il s’est distingue par sa précocité intellectuelle et compte parmi les grands savants Shiites et les authorities de reference. Muhaqqiq Hilli décède en 676 H.
Le livre sharā’I’ al-islām fī masā’il al-halāl wa al-harām (les dispositions légales de l’islam sur les question de licite et de l’illicite) fait partie de l’anthologie juridique de l’école des Ahl-ul-Bayt, a été écrit en arabe en 670 H (1248 J.C.) et fut ensuite traduit en person, anglais, français et ourdou. Près de deux cent seize commentaires ont été écrits sur ce livre, qui a par ailleurs inspiré la plupart des travaux jurisprudentiels ultérieurs.
Cet ouvrage est divisé en quatre partices: la première traite des devoirs religieux; la deuxième, des contrats et obligations synallagmatiques; la troisième, des actes unilatéraux, et la quatrième referme les prescriptions relatives à la chasse, aux aliments, etc., et traite de la pénalité applicable aux crimes et délits, au double point de vue du droit canon et du droit civil.
La distinction entre ces diverses parties n’est sans doute pas aussi rigoureuse que celle qui existe dans nos codes français; mais j’ai cru devoir ne pas m’écarter du plan suivi par l’auteur, afin de faciliter les references au texte arabe.
