الصفحات التالية في عقد البيع في القانون المصري تفترض أن القارئ قد استوعب النظرية العامة للالتزامات وفقه قواعد التفسير. وهذه الصفحات القليلة التي حاولنا أن تكون واضحة رغم تركيزها الشديد يصلح أن يطلق عليها عنوان "بداية المجتهد ونهاية المقتصد في عقد البيع" وليس هذا فقط لأننا نعتز بابن رشد الحفيد ونريد أن نقتفي اثره في عنونة كتبه وانما لأنها حقاً تكفي من يريد أن يقتصر علي التعرف علي وجه الدقة علي الحلول الوضعية في الموضوعات المتصلة بعقد البيع في القانون المصري. ولكنها علي وجه اليقين لا تكفي من يريد التوسع والتعمق بعد أن نضعه علي الطريق المستقيم، فهذه الصفحات المختصرة لا تغني الباحث المجتهد عن قراءة مؤلفات الفقه المصري الغزيرة في عقد البيع.
والجديد في هذا الجزء الذي خصصناه لعقد البيع في التقنين المصري هو الاهتمام بأحكام محكمة النقض المصرية وخاصة تلك الاحكام التي صدرت في العشر سنوات الماضية. وقد أسعدنا أن نجد- بعد غيبة طويلة خارج أرض الوطن- أن أحكام النقض قد حسمت الكثير من المشكلات التي كانت مثار نقاش وأن هذه الثروة العظيمة من الأحكام مازالت في حاجة ماسة إلي الدراسة والتمحيص وقد حرصنا علي متابعة أحكام محكمة النقض المنشورة حتي تاريخ نشر هذا الجزء وهي لا تتجاوز أحكام شهر يونيه 1977 المنشورة بمجموعة أحكام محكمة النقض الصادرة من الدائرة المدنية لسنة 28.
