La catastrophe, situation potentiellement génératrice de dommages collectifs, nécessite la mise en œuvre de mesures spécifiques, notamment dans l’intérêt des victimes.
Elle pose la question de la réparation dans des termes nouveaux mécanismes. La réparation du risque sériel ou de l’accident collectif s’inscrit en effet dans un processus global qui conduit au- delà de la compensation financière du dommage et présente des aspects rétributifs.
La perturbation, voire l’inadaptation, des mécanismes traditionnels d’indemnisation impose une modélisaton des modes de réparation. Outre la reconnaissance de prejudices exceptionnels, spécifiques aux situations collectives, les procédures d’indemnisation doivent traduire le caractère collectif de l’événement. A la nature collective du fait générateur répond ainsi l’organisation collective des modalités d’indemnisation.
La pleine réparation des victimes, le besoin de justice sociale, la prévention de la réitération des événements catastrophiques imposent encore l’affirmation d’une responsabilité individuelle et la sanction des auteurs fautifs.
