اذا وقع اعتداء على حق من الحقوق ، فإن لصاحب الحق ان يطالب الدولة- ممثلة في المحاكم - بان تدفع عنه هذا الاعتداءوان ترد له حقه . ولما كانت المطالبة بالحق والدفاع عنه امام المحاكم تحتاج إلى دراية بالقانون، بعد تشعب فروعه، والمام بالاجراءات المتعددة الواحد اتباها أمام المحاكم ، واصبح من الضروري الاستعانة بشخص مثقف ثقافة قانونية متخصص في متابعة الاجراءات ، امام القضاء لدفع الاعتداء على الحق من هنا برزت ضرورة توكيل شخص لدع الدعوة امام المحاكم ومتابعتها حتى يصدر حكم فيها يعيد لصاحب الحق حقه، ويسمى هذا الشخص " الوكيل بالخصومة " الذى هو فى العادة "المحامي". فإذا كانت فكرة الوكالة قد ظهرت لتسهيل التعمل بين الاشخاص نظرا لوجود عقبات في بعض الاحوال اذا حاول الشخص ان يقوم ببعض اعماله بنفسه لذلك ابيح له ان يوكل شخصا من الغير - اقدر او اكثر خبرة - بالقيام بهذه الأعمال لمصلحته ، فان فكرة الوكالة بالخصومة "توكيل شخص لمتابعة الاجراءات امام المحاكم" انما ظهرت استنادا إلى نفس المنطق: توكيل محامي ملم بالقانون للحصول على الحماية القانونية للحق. فالوكالة بالخصومة صورة من صور الوكالة بصفة عامة ، او ما يسمى بالوكالة الاتفاقية. واننا في هذا المجال لن نتعرض للوكالة - الاتفاقية من مختلف الجوانب - باعتبارها عقدا من العقود فهذا مجاله الدراسات المدنية وليست الاجرائية. ولكننا سنركز على الوكالة بالخصومة فقط. مع الوضع في الاعتبار من خلال فكرة الوكالة بصفة عامة لذلك فاننا سنتعرض للقواعد التى تحكم الوكالة بالخصومة من خلال شرح قواعد الوكالة في القانون المدني. وسوف تتعرض اولا للوكيل بالخصومة ، من يصح ان يكون وبعد ذلك المركز القانوني للوكيل بالخصومة. واخيرا انتهاء الوكالة بالخصومة. هذه هى الموضوعات الأربعة التى سنتولى دراستها على الترتيب. على ان نحدد قبل ذلك مفهوم فكرة الوكالة واختلافها عن اهم الافكار التى تقتبر منها ، وبالذات فكرة النيابة وفكرة الفضالة.
