يأتي هذا الكتاب في وقت تتجه فيه الدولة اللبنانية إلى خصخصة مرافقها العامة ذات الطابع الصناعي والتجاري، واللجوء إلى القطاع الخاص لإدارة هذه المرافق، ويرجع ذلك إلى عدم نجاح القطاع العام في إدارتها بسبب طبيعتها الاقتصادية التي تخضع لقواعد المنافسة والحاجة إلى المرونة في تشغيلها.
وقد تناول الباب الأول الطرق التقليدية لخصخصة المرافق العامة، وهي: الامتياز والشركات المختلطة، فالطريقة الأولى ما زالت معتمدة في لبنان وفقاً للنظام التقليدي لامتياز المرفقالعام، في حين اعتمدت الطريقة الثانية بصورة ضيقة على الرغم من أهميتها وتناسبها مع الأوضاع القائمة في لبنان ودول العالم الثالث.
أما الباب الثاني فعالج الطرق المعاصرة لخصهصة المرافق العامة كعقد البناء والتشغيل والتحوي (B.O.T) الذي اعتمد في لبنان والعالم في بناء وتشغيل المرافق العامة الاقتصادية والكبرى. وكما تناول هذا الباب تفويض المرفق العام، وهي: الامتياز والشركات المختلطة، فالطريقة الأولى ما زالت معتمدة في لبنان وفقاً للنظام التقليدي لامتياز المرفق العام، في حين اعتمدت الطريقة الثانية بصورة ضيقة على الرغم من أهميتها وتناسبها مع الأوضاع القائمة في لبنان ودول العالم الثالث.
أما الباب الثاني فعالج الطرق المعاصرة لخصخصة المرافق العامة كعقد البناء والتشغيل والتحويل (B.O.T) الذي اعتمد في لبنان والعالم في بناء وتشغيل المرافق العامة الاقتصادية الكبرى. وكما تناول هذا الباب تفويض المرفق العام الذي أخذ به في فرنسا كنظام قانوني يحكم العقود المتعلقة بإدارة المرافق العامة الاقتصادية.
واستند المؤلف إلى التشريعات اللبنانية والمبادئ القانونية العامة التي كرسها مجلس شورى الدولة في لبنان، دون إغفال الفقه الفرنسي والاجتهادات القضائية الصادرة عن القضاء الإداري الفرنسي. ويهدف ذلك إلى تطوير الفكر القانوني اللبناني بصورة تسمح للمشرع بأن يعتمد في المستقبل أساليب حديثة ومتطورة في إدارة المرافق العامة.
