قال رسول الله صلى الله عليه وسلم: "لا تزول قدما عبد حتى يسأل عن أربع: عن عمره فيما أفناه، وعن علمه ما فعل فيه، وعن ماله من أين اكتسبه وفيم أنفقه، وعن جسمه فيم أبلاه".
"إن عقلاء الناس مجمعون على وجوب طلب ما ينفع، وترك ما يضر، ورحى الحياة دائرة منذ أن كانت على هذا المبدأ المسلم له، بيد أن إدراك الناس لما ينفع أو يضر، يختلف اختلافاً كبيراً بين إنسان آخر، وهذا عائد إلى تفاوت المدارك البشرية في القوة والضعف والسلامة والنقص، فكم من نافع رأى قوم أنه ضار، فتركوه لما توهموا من ضرره، وكم من ضار أقبل عليه الناس واعتقدوا، فأتواه وفعلوه، يضاف إلى ذلك أن أشياء كثيرة قد يخفى أمرها ويلتبس حالها، ولا يدرى هل هي من النافع الذي يجب أن يطلب أو من الضار الذي يجب أن يجتنب ويترك، ويشهد لهذه الحقيقة قوله صلى الله عليه وسلم: "الحلال بين، والحرام بين، وبينهما أمور مشتبهات لا يعلمها كثير من الناس".
إن الحلال هو النافع، والحرام هو الضار، ومنهما ما هو معلوم النفع بالضرورة، ذلك كنفع العسل، أو معلوم الضرر بالضرورة كضرر السم، وكنفع الإحسان وضرر الإساءة، ولكن دون ذلك أمور كثيرة لا يعرف نفعها أو ضررها إلا ذوو الخبرة والإدراك، الصحيح من عقلاء البشر وحكمائهم.
ومن ذلك مادة التبغ أو الدخان كما يقول العوام، فقد خفي أمرها والتبست على كثير من الناس حالها، فقال أناس: بضررها وتركوها، ودعوا إلى تركها واجتنابها، وقال آخرون: بخلاف ذلك ونفوا عنها الضرر، وقالوا: بإباحتها لسلامتها من الضرر واستعملوها...
والحق: أن هذه المادة السامة الفاسدة قد شغلت أذهان كثير من الناس"، لكثرة انتشارها، مع ظهور ضررها، فتشمر كثير من العقلاء في بيان أمرها وما تشتمل عليه من أضرار، وكان من جملة هؤلاء الكتاب العلامة الشيخ أبو عبد الله محمد بن أحمد بن محمد عليش، فكتب رسالة مستقلة في الدخان، ونشأته، ومفاسده، وحكم الشرع فيه، ثم ذكر بعض الحكايات عن مستعمليه، كل هذا بعبارة وجيزة، وأسلوب لطيف.
وهذه الرسالة اللطيفة طبعت ضمن كتابه الذي أسماه: "فتح العلي المالك في الفتوى على مذهب الإمام مالك"، وهي طبعة قديمة مليئة بالأخطاء... وهذا ما دعى المحقق "مجدي بن عبد الوهاب الأحمد" لفصلها عن متن الكتاب، وغنى بتحقيقها وتصحيح الأخطاء الواردة فيها، كما قام بالتعليق عليها، بما رآه مناسباً من غير إطالة.
