صدر القانون رقم 145 لسنة 2006 بتعديل بعض أحكام قانون الإجراءات الجنائية وفاءً بما وعد به السيد رئيس الجمهورية فى برنامجه الانتخابى وفى خطابه أمام الاجتماع المشترك لمجلسى الشعب والشورى فى بداية الدورة البرلمانية لمجلس الشعب من ضرورة إجراء تعديلات على الأحكام الخاصة بالحبس الاحتياطى لتحقيق حماية أشمل لحق الإنسان فى التنقل، بحيث يكون المساس بهذا الحق فى إطار تنظيم دقيق، لا يتجاوز به القدر الضرورى اللازم لمقتضيات التحقيق وصون أمن المجتمع. وبمقتضى التعديلات التى جاء بها ذلك القانون أصبحت مرآة حماية حرية التنقل فى مصر ساطعة مضيئة، ولم يفت المؤلف أهمية هذا الإنجاز الضخم، فقدم هذا الكتاب الذى عُنى فيه ببيان فلسفة التعديلات الجديدة، والأحكام الدستورية للحبس الاحتياطى، ثم استعرض الأحكام التشريعية لهذا الحبس، مستجليًا ما طرأ عليها من إصلاح ، خاصة فيما يتعلق بمدة الحبس وحالاته ودواعيه وتسبيبه والطعن فى الأوامر الصادرة به والضمانات المستحدثة فى شأن ذلك جميعه. وقد عنى المؤلف بعد ذلك بدراسة بدائل الحبس الاحتياطى التى أتت بها التعديلات الجديدة، والإفراج المؤقت عن المحبوس احتياطيًا، وببيان الحالات التى يتحول فيها الحبس التنفيذى إلى حبس احتياطى عند إنزال حكم القانون. ومن إيجابيات هذا المؤلَّف: شرح الرقابة القضائية على الحبس الاحتياطى، سواء عن طريق الطعن أو عن طريق التعويض، فى ضوء ما سجله القانون من تقرير مبدأ التعويض المادى الذى ترك تحديد تطبيقه للمشرع فى مناسبة أخرى. وللمؤلَّف بجميع ما احتواه من موضوعات مهمة وأبعاد مختلفة فضل كبير فى استجلاء التقدم الذى أحرزه المشرع المصرى فى مجال حماية الحرية الشخصية فى مواجهة الحبس الاحتياطى، وبسط الحلول المختلفة للمشاكل التى تثور عند التطبيق العملى، وهو يسد فراغا كبيرا فى المكتبة القانونية فى مجال الموضوعات التى تناولها.
