كنت أشعر في نفسي بميل إلى البحث عن تاريخ القضاء الإسلامي كيف نشأ ثم تطور إلى أن وصل إلى الحال التي هو عليها الآن وكيف كان حال رجاله في القرون الأولى وفي أي شئ كانوا ينظرون وكيف زاد علمهم- ثم نقص حتى كاد يتلاشى.
بحثت كثيرًا على كتب في هذا الموضوع فلم أوفق وسألت ممن ظننت أن عنده علمًا بذلك فلم أظفر بفائدة فكانت هذه الناحية من نواحي التاريخ مجهولة.
نعم توجد كتب عني أصحابها بنقل أخبار القضاة وأحوالهم وما قيل من خير أو شر فيهم من ذلك كتاب أخبار قضاة مصر لأبي عمر محمد بن يوسف بن يعقوب المعروف بالكندي المولود سنة 283هـ المتوفى في شهر رمضان سنة 350هـ فإنه تكلم فيه عن قضاة مصر وتاريخ توليتهم ووفاتهم أو عزلهم وذكر شيئًا من أخبارهم وقضاياهم ابتدأه بذكر أول قاضي قضى بها في الإسلام وانتهى فيه إلي آخر زمن القاضي بكار الذي تولى القضاء بمصر من قبل المتوكل في شهر جمادي الآخرة سنة 246 هجرية، ومنه ما هو مطبوع ومنها ما هو مخطوط.
أما كون اللغة العربية ليس فيها كتب مخصصة للبحث عن نشوء نظام القضاء في الإسلام فأمر نسلم به إذ لم نظفر بواحد منها بعد البحث الطويل وإن كان ذلك لا يدل على عدم الوجود في الواقع لأن كتب الإسلام ضاع أكثرها من بلاد الإسلام خصوصًا كتب بغداد والأندلس، وعلى هذا فقد عزمت على أن أجمع هذه المتفرقات التي قيدتها وأرتبها وأنشرها في كتاب وهي وإن كانت نقل عن المطلوب إلا أنها كثيرة الفائدة لأن من يقرأها يجد فيها كثيرًا من الحقائق المجهولة ولا يكاد يأتي على آخرها إلا ويجد في ذهنه صورة صحيحة للقضاء الإسلامي ويعلم نشوءه وتطوره وما كان لرجاله من عظمة واحترام.
