بدأت المصارف والشركات الإسلامية مسيرتها منذ عهد قريب، في طريق عقباته كثيرة ومصاعبه ليست قليلة، وقد حاول العلماء المعاصرون إيجاد سبل لإستثمار الأموال بطرق مشروعة تقوم على أساس صحيح من نظام المعاملات في الإسلام.
ومن هذه الطرق ما اصطلح على تسميته (بيع المرابحة للآمر بالشراء) وأخذوا في تأصيل هذا العقد وفق الأصول الشرعية وما أن بدأت المصارف الإسلامية بتطبيق هذا البيع حتى نشأ نقاش علمي عميق في مدى شرعية هذا النوع من المعاملات وعقدت الندوات والمؤتمرات وقدمت البحوث وألفت الكتب مما أثرى المكتبة الإسلامية في هذا الباب الذي كانت تفتقر إليه.
وقد كان المؤلفون والباحثون بين مؤيد ومدافع عن هذا العقد وبين معارض له بإعتباره يتنافى مع أصول العقود الصحيحة وقد اخذت معظم المصارف الإسلامية وكذلك الشركات الإسلامية بهذا العقد وتعاملت به وفق شروط وضوابط محددة بناء على رأي العلماء الذين أجازوه وكان من ضمن هذه الشركات التي أخذت به وتعاملت به (شركة بيت المال الفلسطيني العربي).
وهي أول شركة تنشأ في فلسطين تتعامل وفق أحكام الشريعة الإسلامية وقد رغبت في المساهمة في دراسة بيع المرابحة للآمر بالشراء من الناحيتين النظرية والعملية التطبيقية، فكانت هذه الدراسة المشتملة على الجانب النظري من حيث التعريف ببيع المرابحة وحكمه عند الفقهاء المتقدمين، ثم التعريف ببيع المرابحة للآمر بالشراء، وإختلاف الفقهاء المعاصرين فيه وبيان أدلتهم مع بيان القول الراجح في المسألة.
وأما الجانب العملي فتحدثت فيه عن نشأة شركة بيت المال وأهدافها ونشاطاتها الإستثمارية وكيفية تعاملها ببيع المرابحة للآمر بالشراء والخطوات المتبعة في ذلك، وتعرضت للشبهات التي أثيرت حول تطبيق بيع المرابحة للآمر بالشراء وأجبت عليها.
