لما كانت نصوص قانون الشركات الأردني النافذ قد نظمت احكام التنازل عن حصة الشريك في شركة التضامن، إلا أنها لم تنظم الآثار التي يمكن ان تترتب على هذا التنازل وكذلك جاءت نصوصه خالية من أية احكام تتعلق برهن الحصة أو الحجز عليها، أما قانون الشركات العراقي رقم 21 لسنة 1997 فقد تضمن فيما يخص التصرفات (التنازل، الرهن، الحجز) نصوصاً غير كافية وغير متضمنة لأحكام تلك التصرفات والتي من الممكن أن ترد على حصة الشريك.
لذلك سنحاول من خلال هذا الكتاب التوصل إلى معالجة القصور التشريعي في قانون الشركات الأردني وقانون الشركات العراقي فيما يتعلق بالتصرفات الواردة على حصة الشريك في شركة التضامن.
