تواكب هذه الدراسة دخول القوات الأميركية للعراق (2003)، حيث أصبحت البلاد تحت إمرة المحتل الأميركي في سياق مستتر بإسم التعمير، وإبرام العقود لشركاته وحلفائه، ومن ساهم معه في احتلال العراق، بأسعار هي أقرب ما تكون إلى تقسيم الغنائم فبات لكل مؤسسة ما يسمى بالمنسق الأميركي، فهو يبت في الأمور: يعين ويفصل، ويشرف على المقاولات ويوعز بصرف الرواتب والمستحقات.
ولكن، ما هو موقف الشرع الإسلامي في (التعامل التجاري مع غير المسلمين) هذا هو ما شغل ذهن الباحث الدكتور أحمد حسن الطه. فخصه بدراسة فقهية مقارنة عن التعامل المالي مع المحتل، وبكلام آخر التعامل التجاري مع غير المسلمين سواء أكانوا من أهل دار الإسلام – أهل الذمة – أم مستأمنين أم معاهدين أم حربيين محتلين أو غير محتلين.
على ضوء تعاليم الإسلام وهدي رسوله الكريم تأتي طريقة المؤلف ومنهجه في البحث، فيبدأ بذكر الموضوع، أو المسألة – كالبيع مثلاً أو الصرف، أو المضاربة، أو الشفعة، فيتناول معناها في اللغة، والإصطلاح الشرعي، ثم يذكر أصل المشروعية من الكتاب والسّنة والإجماع، ثم يذكر الحكم الشرعي لها، من وجوب أو ندب، أو غير ذلك، مع بيان حكمة التشريع، وأهمية المسألة. ثم يتعرض لمذاهب العلماء فيها – ويستعرض كل مذهب على حدة ثم يذكر ما ورد على أدلة كل فريق، ويشير إلى رجحان ما يظهر له رجحانه من الأقوال، مبيّناً سبب الترجيح، مع بيان سبب مرجوحية مخالفه، ووجه ذلك من خلال أدلة كل طرف من الأطراف. بعد ذلك يتناول حكم المسألة مع غير المسلمين – من جواز أو عدمه، أو استحقاق وعدمه، وخلاف الفقهاء في المسألة، ويناقش أدلة كل فريق وترجيح الراجح فيما يراه والله أعلم.
