شمل البحث محورين من محاور التّراث الإسلاميّ هما النّظريّة الأصوليّة والممارسة الفقهيّة.
وكان المدخل إليهما "المتمّمات" أو الأصول "التّكميليّة" متمثّلة في الإستحسان والمصلحة المرسلة والعرف، وإن كانت هذه الإصطلاحات ذاتها متأخّرة ومتداخلة بعضها مع البعض حيث يصعب الفصل بين أصول الرأي والنّفع والعمران.
واقتضى البتّ في الشّكل الحقيقيّ لــ "أثر الأصول التكميليّة في فقه السنّة" توسيع مجال الدّرس ليشمل ثلاثة مذاهب تشترك في إنتمائها الشّكليّ إلى التيّار السنيّ، ونقصد المالكيّة والحنفيّة والشّافعيّة، وتوسيع المدى الزّمنيّ بالإنطلاق من المراحل التّأسيسيّة وصولاً إلى المتأخّرين من العلماء المنتمين إلى مدارس مختلفة في الظّاهر، وهنا تطرح قضيّة على درجة بالغة من الأهميّة هي معنى "التّمذهب" الفقهيّ الإسلاميّ، وإنحسار وظيفة العالم المتأخّر في ظلّ بحثه الدّؤوب عن الإنتماء إلى الجماعة أو الثّقافة العالمة الرّسميّة.
وتوزّع العمل إلى ثلاثة أبواب: تناول الأوّل الأصول "التّكميليّة" في الخطاب الأصوليّ، إذ تحوّلت وظيفة العلم من التّأصيل إلى الإستئصال بتطويق أدّلة الإجتهاد المطلق والإستصلاح والعادة، لأنّ اعتمادها يقوّض الهدف الذي نشأ علم الأصول من أجل تحقيقه وهو "التّوحيد الفقهي" من خلال "التّوحيد الأصوليّ".
بينما كان الرّهان الأكبر الموكول إلى الباب الثّاني مواجهة الخطاب الأصوليّ بالمادّة الفقهيّة الّتي يُفترض إنطلاقه منها وقيامه بتقنينها في أطر وقواعد، ولكنّ الحقيقة الكبرى أنّ أثر أصول الرّأي والعمران في الفقه يتعارض مع تصنيفها في خانة المتمّمات.
أمّا الباب الثّالث فقد كان تأليفاً بين خصائص التّراثين الفقهيّ والأصوليّ، قصد التّمييز بين المركزيّ والهامشيّ في هذين التّراثين، ومقاربة ماهيّة النصّ الدّينيّ التّشريعيّ، فإذا "النصّ وظيفة": سلاح لمواجهة خطر الإختلاف الفقهيّ وإن اقتضى اعتمادُه خلقَه، وإذا النصّ - في طبيعة وغاياته - بشريّ أكثر منه إلهيّاً.
