Book Description
"كتاب الجامع" إنّما هو حذق في التصنيف انفرد به الإمام مالك رحمه الله ثم اقتفى أثره في ذلك كثير من المصنفين من مذهبه ومن غير مذهبه، لأنّ "كتاب الجامع" جمع فيه مالك ما لم يترتب له على ما صنّفه في الأحكام، فجمع شتات ذلك في "الجامع"، قال الإمام ابن العربي: هذا كتاب أَرْبَى مالك رحمه الله على المحدثين، وطرقَ لهم في التّصنيف، وفتح فيه لجماعة من المسلمين المصنّفين باباً عظيماً، فأتى فيه بالعَجَبِ العُجَاب.
وقال موضحاً في موضع آخر: هذا كتاب اخترعه مالك رحمه الله في التصنيف لفائدتين: أحدهما: أنَّه خارج عن رسم التكليف المتعلق بالأحكام التي صنفها أبواباً ورتبها أنواعاً.
والثاني: أنَّه لمّا لحظ الشريعة وأنواعها، ورآها منقسمة إلى أمر ونهي، وإلى عبادة ومعاملة، وإلى جنايات وعبادات، نظمها أسلاكاً، وربط كل نوع بجنسه، وشذّت عنه من الشريعة معان مفردة، لم يتفق نظمها في سلك واحد؛ لأنها متغايرة المعاني، ولا أمكن أن يجعل لكلٍ منها باباً لصغرها، ولا أراد هو أن يطل القول فيما يمكن إطالة القول فيها، فجمعها أشتاتاً، وسمّى نظامها "كتاب الجامع" فطرق للمؤلفين ما لم يكونوا قبل ذلك به عالمين في هذه الأبواب كلها.
وقال الشهاب القرافي: هذا الكتاب يختص بمذهب مالك لا يوجد في تصانيف غيره من المذاهب، وهو من محاسن التصنيف؛ لأنه تقع فيه مسائل لا يناسب وضعها في ربع من أرباع الفقه؛ أعني العبادات، والمعاملات، والأقضية، والجنايات، فجمعها المالكية في أواخر تصانيفها وسموها بــ "الجامع"؛ أي جامع الأشتات من المسائل التي لا تناسب غيره من الكتب، وهي ثلاثة أجناس: ما يتعلق بالعقيدة، وما يتعلق بالأقوال، وما يتعلق بالأفعال، وهو الأفعال والتروك بجميع الجوارح.
