«الثواب والعقاب في كتب التفسير» محاولة لتقديم أنموذج لتفسير التراث الديني من خلال كتب التفسير وأثرها في التشريع الإسلامي.
إنها محاولة انطلقت من مقاربة الخطاب الدينيّ مقاربة فينومينولوجية، وأدت إلى الاستعانة بالأنثروبولوجيا القضائيّة. فكلّ مظاهر الجزاء التي تمّ تحليلها ليست سوى دلالات بسيطة في المتخيّل القائم في الذّهن الذي تخزّنه الثّقافة وتكرّره ليكون فيه أساس المعتقد الذي يقوم عليه القانون بمعناه الأكثر تجريداً. وقد حرّك هذا البحثَ سؤالٌ ملحٌّ: بأيّ معنى نفهم أن الدّيني له منطق يجب تفكيكه؟
فهذه محاولة للكشف عن ذلك المنطق الذي عبّرت عنه السنّة الثقافية الإسلامية من خلال المتخيّل الخاص بالجزاء تعبيراً بليغاً اشتركت فيه مع باقي الإنسانية في ثوابت أنثروبولوجية وإن اختلفت في تأويلها.
وقراءة الكتاب تبين أوجهاً لهذا الاشتراك والاختلاف. وليس لنا من غاية إلا فك الارتباط بالتأويل الأنطولوجي القديم وتأسيس أنطولوجيا لا تقوم إلا على الوعي بوجوب عقد يختاره الإنسان بإرادته الحرّة، ويكون قادراً حينئذٍ على تأسيس القوانين باعتباره فرداً حراً مسؤولاً عن حياته ومصيره.
فهذا الكتاب ليس نظراً في الأحكام ولا الحدود ولا الجنة والنار من وجهة نظر تاريخيّة بل محاولة لتفكيك وفهم وتأويل التأويل الذي أنتجهما وصاغهما وجعلهما معنى، لا مجرّد معنى لنص من النصوص بل معنى لكل الحياة. إن القارئ واجد فيه منظوراً يمكنه أن يدعمه أو يفنّده ولكنّه يسلّط الضوء بأدوات المعرفة المعاصرة المتطورة على قابلية فهم لا يمكن أن تحتكرها مؤسّسة دينيّة. وعسى تكون هذه المحاولة لبنة من لبنات تحديث مجتمعنا المعاصر.
