إن مسألة الحجاب ولباس المرأة عند الأجانب من المسائل الجليّة، ولم تحتج على مرِّ قرون الإسلام إلى فقيه يصنفُ بها مؤلفاً مفرداً، ولم يكن أئمة المذاهب الأربعة يفردونها بفصولٍ، وإنما تردُ في كلامهم إستطراداً وتبعاً لغيرهاح لوضوح حكمِها وجلائه.
وكانت أدلةُ الحجابِ واللباس توضعُ في موضعها الذي أنزلت فيه، وتجري على العمل الذي كان الصحابة وأتباعُهم عليه، حتى جاء القرنُ الرابع عشر والخامس عشر للهجرة، واحتلَّ أكثرُ بلدان الإسلام فأخذت أدلةٌ ووضعت في غير موضعها، وجُعلت أقوال الفقهاء في غير سياقها، فلم يفرَّق بين حرَّة وأمةٍ، ولا بين شابَّةٍ وعجوزٍ، ولا بين ما قبلَ فرضِ الحجاب وبعدَه، ولا بين محكمٍ ومتشابِه!...
حتى ظهر الترويج لأقوالٍ لا تعرفُها مذاهبُ الفقهاء، ونُسِب إلى مالكٍ وأبي حنيفةً والشافعي القولُ بــ (أن تغطية المرأة لوجهها ليس بشريعةٍ)، أو بـ (أنَّه يستوي في المرأة تغطية وجهها وعدمه، ولا فوق في ذلك بين فتنةٍ وغيرها، وأنَّ المرأة لا تأثمُ بكل حالٍ)!... ويؤخذ كلامُهم في عورةِ الستر والصلاة فيجعل في عورة النظر، حتى يظنَّ القارئ - من كثرة تعارض النقول وتضادَّها - إضطراب المذاهب وتناقُضَها!...
وقد قال الفقيهُ الشافعيُّ محمَّدُ بنُ عليِّ المَوْزَعيُّ المتوفى (825هـ)، في كتابه "تيسير البيان": "والسلفُ كمالكٍ والشافعيِّ رأي حنيفةَ وغيرهم، لم يتكلموا إلا في عَوْرِةِ الصلاةِ... وما أظنُّ أحداً منهم يُبيحُ للشابَّةِ أن تَكشِفَ وجهَها لغيرِ حاجةٍ".
