Book Description
بعث الله نبيه محمد (صلى الله عليه وسلم) بهذا الدين الحنيف الذي يرشد إلى الخير ويهدي إلى سواء السبيل، ولأهمية الدين في حياة الإنسان جُعِل حفظه أهم مقاصد الشريعة الإسلامية، فلا يمكن أن يكون هذا المقصد العظيم معرضاً للضياع والتحريف، لأن في ذلك ضياعاً للمقاصد الأخرى. ومع أنّ الله تعالى قد تكفّل بحفظ هذا الدين، وذلك كما في قوله عزّ وجلّ: (( إنّا نحن نزلنا الذكر وإنّا له لحافظون))، فقد شرع لحفظه عدة وسائل من أعظمها الجهاد في سبيل الله. ولقد حثّ النبي (صلى الله عليه وسلم) على الجهاد في سبيل الله، إدراكاً منه لعظم هذه الوسيلة في حفظ الدين من جانب الوجود، وذلك بإقامة أركانه وتثبيت قواعده، ومن جانب العدم، وذلك بدرء الاختلال الواقع أو المتوقع فيه. لذا كان لابد من الاستعداد للجهاد، بجميع أنواعه، فالجهاد أقسام: جهاد بالنفس، وجهاد بالمال، وجهاد بالقلم واللسان، وإعداد القوّة مأمور به في جميع هذه الأقسام. هذا وإن من وسائل الاستعداد للجهاد إجراء السبق بين المتنافسين، لما له من دور كبير في إذكاء روح المنافسة، ومن ثم رفع الكفاءات والمهارات بجميع أنواعها.
ونظراً لأهمية السباق، فإن النبي (صلى الله عليه وسلم) لم يكتفِ بالتوجيه إليه؛ بل ثبت عنه أنه صارع وراكض وحضر السباق والنضال، وكان يجيز أصحابه في البعث بالغلبة والمصارعة.
من هنا تأتي أهمية هذا البحث الذي يتناول المؤلف من خلاله أهميّة السبق في الشريعة الإسلامية، في محاولة لإبراز هذا الموضوع، وبعد لمّ شتاته من المصادر والمراجع الفقهية والحديثية التي جاء فيها ذكره، ودراسته، كعقد مستقل له أحكام وشروط، كما وبيان صحيح السبق من فاسده. بالإضافة إلى ذلك فإنّ ما دفع المؤلف للبحث في هذا الموضوع: ظهور أنواع من السابقات الحديثة والتي لم تكن في عصر الفقهاء الأقدمين، فكان لابد له من البحث عن الحكم الشرعي لهذه المسابقات بتطبيقالقواعد التي أصلها الفقهاء في هذا الباب، إلى جانب صلة هذا الموضوع بحياة الناس على اختلافها، ودخوله في كل مجال، حيث حلّ السبق في المجالات التجارية والرياضية والفنية والعلمية، كما أنّ لهذا الموضوع خطورة، ويكمن ذلك في كون القمار يعتري عقد السبق في بعض صوره، لذا عمد المؤلف لتناول هذا الموضوع: عقد السبق، كعقد مستقل عن بقية العقود الأخرى؛ كلإجازة والجعالة مثلاً، وبيان أن له أحكامه الشرعية المستقلة والتي يختص بها، فلا تُؤخذ أحكامه من بقية العقود.
