مجال هذا البحث يتحدد فى إطار واحد لدراسة "الجماعات المحلية الإدارية", وهذا يعنى الجماعات الإنسانية التى لها وضعاً قانونياً محدداً, وتستطيع أن تدير بنفسها شؤنها الخاصة فى داخل جماعة عامة أكثر إتساعاً التى تشكل بالنسبة لها مركزاً مشتركاً. وسنعمل على إستبعاد الجماعات الوسيطة الأخرى التى لها أوضاعاً خصوصية والتى تقابلها فى الدول الفدرالية تحت مسميات مختلفة: دولة عضو فى الولايات المتحدة الأمريكية, كانتون فى سويسرا, "بلاد" أو "Landar" فى جمهورية ألمانيا الفيدرالية, إلخ, أو حتى فى ذات إطار الدولة الموحدة مثال الأقاليم فى إيطاليا. وفى الواقع, الوضع القانونى لهذه الجماعات يكون مختلفاً عن ذلك المتعلق بالجماعات المحلية الإدارية- موضوع الدراسة, وتبعاً لذلك, هذه وتلك يجب أن يتم فحصهما تحت زوايا مختلفة, هذا إذا أردنا أن نأخذ فى الحسبان معانيهما القانونية المختلفة, بطريقة عميقة ومنهجية محددة.
وفى إطار هذا التحديد, سوف يتهيكل بحثنا على مجالين:
النظرية العامة للمركزية واللامركزية:
والدراسة فى هذا المجال ستكرس لدراسة المفاهيم المتنوعة للمركزية واللامركزية والأشكال المختلفة المتصورة لهما والمقترحة بمعرفة الفقه التقليدى والحديث. هذه الدراسة سوف تكون معقدة وصعبة, ولكن ضرورية حيث ستزودنا بعناصر صلبة يمكن أن تدعم مسيرتنا فى المجال الثانى من البحث.
النظرية والحقيقة للجماعات المحلية الإدارية:
هنا, الأبحاث سوف تسمح لنا بتعريف وتحليل تلك الظاهرة بمساعدة وجهات النظر الفقهية ومختلف الحلول الوضعية المرتبطة بالعناصر الأساسية التى نعتمد عليها فى تأسيس صرح قانونى منضبط للجماعات المعنية.
ودورنا الأساسى فى هذه الدراسة يتأسس إذن فى أن نضع فى بروز المبادئ الأكثر تأكيداً, والأكثر وضوحاً والأكثر بساطة, وأخذ تطبيقها لقياس قيمة النظم, من وجهة إعطاء موضوعنا قوامه الطبيعى.
