الكتاب الذي بين يدينا هو من أهم كتب الفقه المالكي المشهورة، وهو كتاب "التفريع" لأبي عبيد الله بن الجلاب البصري، ومن أهم وأشهر كتبهم هو كتاب "المدونة" لسحنون، وكتاب "التفريع" هو بمثابة التلخيص للمدونة، عند أهل الفقه المالكي وعند غيرهم لما تحويه من أفكار وآراء استنباطية مبينة ومظهرة لمدى قدرة قوة العقل المسلم والعربي على الانتباع والتيقظ والاستنباط من الكليات والإجماليات وتفصيل المسائل الكلية تفصيلاً دقيقاً كانت ملفتة لأنظار غير المسلمين، فكانت من أهم أهداف الحملات الاستعمارية الغازية التي من أخطرها الحملة الفرنسية على مصر والوطن العربي، التي كان من أهم أهدافها الاستيلاء على المخطوطات العربية، ومن أعم ما استولوا عليه كتاب "المدونة" لما له من قيمة عالية في استخراج الفرعيات من الكليات، والناظر في القوانين الوضعية الفرنسية وكتاب الحدود والسرقات في "المدونة" و"التفريع" يلاحظ ذلك جيداً فقد استفادوا استفادة جمة من مثل هذه الكتب في وضعهم لقوانينهم وفي تفصيلهم لكليات نصوصهم القانونية، فمن هذه المدونة تعلموا وتدربوا على كيفية وضع وصياغة القوانين، والتفصيل للمسائل الكلية والاستنتاج والاستنباط.
وكتاب "التفريع" الذي بين أيدينا كما ذكرنا بمثابة اختصار لتلك المدونة، كما أنه يخلو هو الآخر من الأدلة إلا في القليل النادر.
هذا كتاب في الفقه يعدّ تلخيصاً لكتاب المدونة لسحنون الذي يعد أشهر كتب الفقه المالكي لما حواه من أفكار واستنباطات واستخراج الفرعيات من الكليات والاستنتاج الدقيق مما جعل العالم الغربي يحفل به ويجعله أصلاً لكليات نصوصهم القانونية.
