إن علم أصول الفقه علم عظيم الشأن، رفيع المقام، واسع الروافد والجنان، بما يمثله من أصالة في الفكر الإسلامي أصدق تمثيل، فهو أساس الإجتهاد، وعليه مدار الإستنباط، وفيه تظهر عبقرية علماء المسلمين، ورصانة فكر المجتهدين، وتتجلى إستقلاليتهم في تأسيس مثل هذا العلم الرصين، "وقد سبق به فقهاء الإسلام فقها القانون في العالم كله، إذ لم تعرف المكتبة القانونية أصولاً للقانون إلا في العصر الحديث، في حين عرفت المكتبة الإسلامية تراثاً منهجياً فريداً للبحث الفقهي، نما وتكامل على مدى ثلاثة عشر قرناً أو تزيد، وتبلور في إطار علم أصول الفقه.
ولم تقتصر دراسة جوانب موضوع هذا العلم على تناول الأدلة الشرعية، ومكانتها، وحجيتها، وطرق الإستنباط، ومنهج البحث فيها، بل تعدت ذلك إلى الجوانب اللغوية في لسان العرب وأوضاعه ودلالته، مما جعله بحق فلسفة للفقه الإسلامي، ومنطقاً له، وإطاراً حقيقياً لدراسة الوضعية المتغيرة في الأحوال الإجتماعية، والتكيف مع حالات التطور فيها، وتمثلت هذه الجوانب اللغوية في دراسة دلالة الألفاظ على معانيها، وإستخراج العلل من نصوصها؛ وَوُضِعَ لهذا الجانب إطار؛ سماه الأصوليون: "القواعد اللغوية وطرق إستنباط الأحكام من الأدلة".
ولما لهذا الجانب اللغوي من أهمية بالغة في إستيعاب الأحكام، تصدى علماء الشريعة ورجال أصول الفقه بمختلِف طبقاتهم لضبط طرق الدلالة في الكلام العربي على تنوعها وإختلافها، ووضعوا لذلك نظريات أصولية تحدد موقفهم من كل نوع منها، وكيف يمكن التعامل معها، وفي أي إطار يمكن إستخلاص الأحكام منها، إلى غير ذلك من النظريات التي تحدثوا عنها، بقصد ضبط جوانب العمل بها ومن خلالها.
ويأتي في مقدمة هذه الباحث اللغوية: مفهوم المخالفة أو دليل الخطاب، فقد حظي هذا النوع بإهتمام كبير من قبل الأصوليين عامة، وأصوليي المالكية خاصة، وما ذلك إلا لأنه يشكل أداة فاعلة في تفسير النصوص الشرعية، خاصة في المسائل التي ليس لها طريق آخر عبر طريق المفهوم المخالف للحكم المذكور في النص، كما أنه يعتبر من مباحث أصول الفقه الشائكة والدقيقة، بالنظر إلى ما عرفه من خلافات وردود ومناقشات، سواء من حيث إقراره جملة، أم من حيث إقرار بعض أنواعه التي اختلف أيضاً في تعدادها من المفهوم.
