طه جابر العلواني (1935 - 4 مارس 2016)، هو مفكر وفقيه إسلامي عراقي. كان رئيس المجلس الفقهي بأمريكا، ورئيس جامعة العلوم الإسلامية والاجتماعية (SISS) بهرندن، فرجنيا، الولايات المتحدة الأمريكية. حصل على الدكتوراة في أصول الفقه من كلية الشريعة والقانون بجامعة الأزهر في القاهرة، مصر، عام 1973. كان أستاذاً في أصول الفقه بجامعة الإمام محمد بن سعود الإسلامية بالرياض، المملكة العربية السعودية منذ عام 1975 حتى 1985. في عام 1981 شارك في تأسيس المعهد العالمي للفكر الإسلامي في الولايات المتحدة، كما كان عضو المجلس التأسيسي لرابطة العالم الإسلامي في مكة المكرمة، وعضو مجمع الفقه الإسلامي الدولي في جدة. هاجر إلى الولايات المتحدة في عام 1983. وكان رئيس جامعة قرطبة الإسلامية في الولايات المتحدة.

عني ابن رشد بمسألة أدب الاختلاف من زاوية لاحظ من خلالها انشغال الفقهاء في عصره بالجزئيات دون التفات يذكر إلى تقرير الأدلة وبيان المدارك الفقهية، وأن تقرير جمهرتهم لمسائل الفقه شابه الكثير من التداخل والخلط؛ فرأى بثاقب نظره أنَّ تناول الفقه بتلك الطريقة أدى إلى عزل الفقه عن أصوله ومصادره، وأن العناية بتناول الفقه بتلك الطرق قد صار جزءًا من عوامل تعطيل ملَكة الاجتهاد، فقرر أن يكتب « بداية المجتهد ونهاية المقتصد » بمنهج مغاير هو منهج الفيلسوف الفقيه الذي يعمل على لفت أنظار الفقهاء إلى فلسفة الفقه؛ لعل ذلك يؤثر في قليل أو كثير في أساليب تعاملهم مع الفقه وأدلته. ولذلك ركز على أسباب الاختلاف منبهًا إلى زوايا النظر في الأدلة.
