إنّ حقوق الإنسان قد غدت العنوان الأكبر الذي تتمايز فيه الأمم وتتنافس في العصر الحديث، ولما كان القضاء، فكراً، ونظاماً، وواقع تطبيقياً؛ الأداة الأبرز لرعاية الإنسان حقوقا وكينونة، فقد أصبحت الملاءمة والموازنة بين القيم العليا الحاكمة للتشريع بشكل عام، وللقضاء بشكل خاص، الشغل الشاغل للمفكرين الحقوقيين والقانونين، سواء منهم المؤمنون بالشريعة الإسلامية، أم العلمانيون.
تلك القيم المتمثلة بالعدل، والحرية، والمسؤولية؛ فإن لكل منها طبيعتها الخاصة، وحدودها التي ينبغي أن لا يَعْدُوهَا أحد، حفاظا على الحق الذي يعد بلا شك الأساس الذي ينطلق أصحاب كل مدرسة فكرية أو فلسفية منه، تلك المدارس والفلسفات التي ما زالت تحيد عن الطريق، وتميل بإحدى كفتي الميزان على حساب الأخرى. بيد أن التشريع الإسلامي ــ وهو تشريع يوازن بين صفتي الواقعية والمثالية ــ استطاع بحق أن يقدم للبشرية أنموذجا غاية في الدقة والصلاحية للتطبيق.
والباحث إذ يقرر مبدأ التوازن في الشريعة الإسلامية في رعايته للإنسان حقوقا وكينونة، فإنه لاحظ أن المسؤولية باعتبارها قيمة عليا تعد في جانبها القضائي النظري نظرية متكاملة الأبعاد، فسعى الباحث إلى إبراز هذه النظرية، التي لم يُتَطرَّق لعرضها والبحث في تفاصيلها، رغم كثرة ما كتب حول المسؤولية في الشريعة والقانون، من كتب ورسائل علمية وأبحاث، فكان لابد من تأصيل هذه النظرية وبيان تفاصيلها، وما ذاك إلا لأن هذا هو الطريق الأمثل للملاءمة بين القيم والحرية، وتحقيقا ووصولا للغاية الكبرى المتمثلة بالعدل. ولاشك أن بيان هذه النظرية لا يتأتى ما لم يبين ماهية النظرية ومصادرها وشروطها وأركانها وصولا الى بيان آثارها.
