كانت طبقة الرقيقة في كل المجتمعات البشرية من أدنى الطبقات رتبة ومنزلة وأكثرها هبوطاً، إلى أن جاء الإسلام فجعل لهذه الطبقة حقوقاً مقررة، وشجع على تحريرها، وجعل "تحرير الرقاب" من أفضل وسائل التقوى والتقرب إلى الله عزّ وجلّ، كما حدد الإسلام ما للعبد من حقوق على سيده وما عليه من واجبات حيث جعلها في حدود ما يطيق.
وتميزت الشريعة الإسلامية عن غيرها من القوانين والشرائع التي أعطت بعض الحقوق للعبيد في أنها ساوت بين الحر والعبيد في حقين عظيمين، فجعلت للعبد حق الإمامة في الصلاة وجعلت من حقه أن يجير العدو المستأمن إذا استجار به، لقول النبي صلى الله عليه وسلم: "ذمة المسلمين واحدة يسعى بها أدناهم".
وقد ذهب بعض الأئمة في التسوية بين الحر والعبد في الشهادة، وذهب آخرون في التسوية بينهما في القضاء.
ومنذ فجر الإسلام، بداية بسلمان الفارسي الذي نصح بفكرة حفر الخندق الشهير حول المدينة المنورة، وعلى مدى حقب التاريخ الإسلامي شهد التاريخ كثيراً ممن كانوا عبيداً ومماليك، وقد لعبوا مع ذلك دوراً حضارياً وسياسياً بارزاً.
وإزاء هذه الفكرة، فقد كان للأندلس ميزة فريدة من نوعها، حيث كان تنوع أجناس هؤلاء العبيد والرقيق مثيراً للدهشة، وقد أفسح التسامح الديني أمامهم المجال للإسهام في تشكيل طيف في الحضارة الأندلسية، والمشاركة في صناعة الأحداث في كثير من الأحيان.
أما هدف من هذه الدراسة فهو تسليط الضوء على مناحي الحياة الإجتماعية والسياسية والإقتصادية والثقافية، التي أنتجتها أو ساهمت في إنتاجها طبقة الصقالية والعبيد المماليك، وذلك توضيحاً لمدى إفادة الاندلس من هذه الإسهامات، وكذلك الآثار السلبية التي تركتها هذه الطبقة عند الأندلسيين على مدى تاريخ الأمويين هناك، وبشكل خاص في الفترة الممتدة من سنة 138هـ / 756م إلى سنة 422هـ / 1031م.
وقد كان البحث ممهداً امامي نظراً إلى كثرة المؤلفين الذين تصدروا لدراسة الأندلس من النواحي الإجتماعية والتاريخية والأدبية والسياسية، غير ان الدراسات التي تناولت قضايا العبيد والموالي والجواري كانت قليلة ومنتشرة في بطون الكتب، لذا بذلت الكثير من الجهد في سبيل تجميعها.
