قدمت اتفاقية مناهضة التعذيب تعريفاً له، على أنه (أي عمل ينتج عنه ألم أو عذاب شديد، جسدياً كان أو عقلياً، يلحق عمداً بشخص ما بقصد الحصول من هذا الشخص، أو من شخص ثالث، على معلومات أو على اعتراف، أو معاقبته على عمل ارتكبه أو يشتبه في أنه ارتكبه، هو أو شخص ثالث، أو تخويفه أو إرغامه هو أو أي شخص ثالث، أو عندما يلحق مثل هذا الألم أو العذاب لأي سبب من الأسباب يقوم على التمييز أيا كان نوعه، أو يحرض عليه أو يوافق عليه أو يسكت عنه موظف رسمي أو أي شخص آخر يتصرف بصفته الرسمية).
كما أن المادة السابعة من نظام روما الأساسي للمحكمة الجنائية الدولية والخاصة بالجرائم ضد الإنسانية قد حددت المقصود بالتعذيب في فقرتها الثانية بند هــ ، حيث نصت على أن التعذيب يعني (تعمد إلحاق ألم شديد أو معاناة شديدة، سواء بدنياً أو عقلياً، بشخص موجود تحت إشراف المتهم أو سيطرته، ولكن لا يشتمل التعذيب أي ألم أو معاناة بنجمان فحسب عن عقوبات قانونية أو يكونان جزءاً منها أو نتيجة لها).
وعلى هدى ما سبق سنعرض في هذه الدراسة لموضوع حق الإنسان في عدم التعرض للتعذيب وذلك من خلال بابين هما:-
الباب الأول: ونخصصه لدراسة حق الإنسان في عدم التعرض للتعذيب في القانون الدولي الجنائي، الباب الثاني: ونوقفه على دراسة تحليلية لحق الإنسان في عدم التعرض للتعذيب في القانون الداخلي.
