تعتبر الدولة أحد أشخاص القانون الدولي الرئيسة ولها بطبيعة الحال وجود وكيان في الجماعة الدولية. ومع أهمية هذا الوجود الذي تحتله الدولة فقد تتعرض لمجموعة من التغيرات تصيب عناصر شخصيتها القانونية وتختفي فيه وجودها في المجتمع الدولي أو تؤثر هذه التغيرات على كيان الدولة المادي دون أن تقضي على شخصيتها أو ذاتيتها. وتثور نتيجة لهذه التغيرات مسألة انتقال حقوقها والتزاماتها إلى الدولة الوريثة كلها أو بعض منها، وهذا ما اصطلح الفقه على تسميته بالميراث الدولي أو الخلافة أو الاستخلاف الدولي.
ويثير موضوع خلافة الدول مصاعب جمة ذات طبيعة مختلفة ينجم عنها إرباكُ في استقرار المراكز القانونية، لكون زوال الدولة الذي يحدث بسبب انضمامها طوعاً أو كرهاً إلى دولة أخرى أو تفتيتها إلى عدة دول أو عبر دخولها ضمن دولة اتحادية جديدة أو غير ذلك من التغيرات التي تنال عنصر الإقليم أو الحكومة فيها، تنشأ عنها نزاعات بين الدولة أو الدول السلف والدولة أو الدول الخلف مما يقتضي حلها وتسويتها نظراً لما يمكن أن تلقيه من تأثير كبير على العلاقات الدولية وما قد تجلبه من إخلال بالأمن والسلم الدوليين في أحيان أخرى.
والحقيقة التي لابد من ذكرها أن موضوع خلافة الدول يحتل مكانة متميزة في القانون الدولي المعاصر، وهذا ما لاحظناه خلال الحقبة الأخيرة من القرن العشرين التي شهدت حالات كثيرة لولادة دول جديدة نتيجة تفكك أو اقتسام أو انفصال أو انحلال دول كانت تدخل في كنفها أو اتحاد بعضها، كما حدث في تفكك الاتحاد السوفيتي ويوغسلافيا السابقة وتشيكوسلوفاكيا وألمانيا واليمن والسودان وغيرها.
