لقد كان القضاء وما زال ركناً أساساً في الحياة، ومرتكزاً مهماً يُعَّول عليه، ومع أن القضاء ثابت في مقاصده النبيلة والسامية والمتجلية بتطبيق أحكام القانون وإحقاق الحق وتحقيق العدالة والمساواة بين أفراد المجتمع بكل حياد، إلا أنه يتطور مع الزمن نظراً لتطور الحياة بما فيها من علوم ومعارف في شتى المجالات الاجتماعية والاقتصادية والسياسية والقانونية كما بات الأمر واضحاً. ومن المسلَّم به أنه ترتب على هذا التطور السريع في شتى ميادين الحياة ظهور نزاعات وقضايا جديدة، دعت القضاء إلى أن يطور نفسه حتى يواكب تطورات الحياة بهدف تحقيق أهدافه السامية النبيلة التي وجِدَ أصلاً من أجلها. ومع كل ما يبذله القضاء من سعي نحو مواكبة التطورات الحاصلة وتأهيلٍ متين للقضاة فيه، إلا أنّ التطور العلمي والتكنولوجي السريع أدى إلى إحداث العديد من التخصصات التقنية التي تجعل القاضي ــ في كثير من الأحيان ــ يقف حائراً أمامها نظراً لخروجها عن اختصاصه ولعدم إلمامه بها ولاستحالة الإلمام بكل العلوم إلا من قبل المتخصصين بها، الأمر الذي يجعل القاضي يضطر إلى الاستعانة بالخبراء والمختصين ؛ بهدف إنارة الطريق أمام القاضي لإماطة اللثام عن هذه المسائل الفنية والتقنية حتى يصدر القاضي حكمه، انطلاقاً مما هو ثابت علمياً بعيداً عن التقديرات الشخصية والمزاجية ليريح ضميره ويحقق العدالة المرجوة. واستعانة المحكمة بالخبراء والمختصين يطلق عليه مصطلح الخبرة القضائية التي تعد وسيلة من وسائل الإثبات التي حددها القانون.
