عندما يقوم نزاع بين أفراد أو جماعات، فإنه يمكن أن يسوي أو يحل بعدد محدود من الوسائل، منها تدخل طرف ثالث، وهذا بدوره يمكن أن يتخذ عدداً من الأشكال من بينها التحكيم، وتقصي الحقائق، والتوفيق، والوساطة، وهي موضوع هذا الكتاب.
وقد حظيت الوساطة بأكبر قدر من الاهتمام بين الباحثين والممارسين العاملين في مجال فض المنازعات. وقد ظهر في العقدين الماضيين عدد من التحليلات العلمية للوساطة النظرية والتطبيق، ومن بينها عدد من المؤلفات تبين أن ممارسة الوساطة هي أقوى أدارة منفردة في حركة تسوية المنازعات، وهي الحركة التي تهدف إلى إيجاد بدائل لرفع القضايا أمام المحاكم. وقد ازدهرت ممارسة الوساطة في الولايات المتحدة (وفي أماكن أخرى ولكن بدرجة أقل)، ويمكن العثور عليها في مجالات تتراوح بين الطلاق والمنازعات داخل المجتمع المحلي، وفي دوائر الأعمال، وشئون العمال، والعلاقات الدولية.
والجوهر في حركة الوساطة -كما يظهر في النظرية والممارسة وفي البحوث الأساسية والتطبيق- هو الرأي القائل بأن الهدف الأساسي للوساطة يجب أن يكون الوصول إلى حل النزاع. وقبل كل شئ فإن الوساطة تجعل في الوسع الوصول إلى اتفاقات، وأن تكون تلك الاتفاقات مرضية للمتنازعين. وهناك هدف مهم أخر للوساطة، وإن كان هدفاً ثانوياً، هو تحسين العلاقة بينهم.
