هل يمكن لعلم من العلوم (أو معرفة من المعارف) أن لا تكون له فلسفة؟ تلك الفلسفة التي تقوم وجهة العلم تصحح منهجه وتطور منطقه وتنظم أبحاثه وتسعفه حين يخبو في البلوغ إلى الأهداف التي يجنح إليها.
يرى الكاتب أننا نعيش في عصر أصبحت فلسفة العلم فيه ملازمة للعلم نفسه، بحيث لا يمكن تصور علم من دون فلسفة، لأن فلسفة العلم هي علم العلم وحكمته التي أخذت على عاتقها مهمة البحث عن قضايا هامة بالنسبة إلى العلم، كالبحث عن البنية المنطقية للعلم، ومنطق تطور العلم، تنظيم العلم، سوسيولوجيا العلم، وذلك ضمن دراسة تحليلة –نقدية من خارج العلم، وبطبيعة الحال فإن الفقه ليس استثناءً من سواه من العلوم التي تسعى وباستمرار لتنمية الفكر الفلسفي بجنب العمل العلمي والمعرفي، صيانة للمعرفة وتسديداً لخطواتها المستقبلية نحو مزيد من التطور والازدهار في بعدها النظري والعملي.
ثم إن تطوير الصناعة الفقهية والعملالاجتهادي باتجاه التنظير، بحاجة إلى مداخل أهمها: تطوير علوم المناهج، فلسفة الفقه وترتيب وتصنيف الموضوعات الفقهية. ورغم الأهمية الكبيرة لهذه الموضوعات فإن الكتابات المعاصرة لم تتقدم بهذا الاتجاه بشكل يدعو إلى التفاؤل، حيث إن جهود المعاصرين اقتصرت على الشرح، وشرح الشرح...
ويهدف الكاتب إلى العمل على تغيير إيجابي في نمط الفكر الاجتهادي، ومراجعة موضوعية للموروث بتجديد لغته ومصطلحاته وأطر تنظيمه وطريقة إدارته ومستويات تحليله، بحيث يصبح أكثر اقتراباً من المستوى الإنساني الحسي والملموس والواقعي، وأكثر إدراكاً للواقع بكل تعقيداته وتعرجاته وأكثر قدرة على الاستيعاب والمعالجة.
