إذا كان التضامن بين المدينين يقدم للدائن ضماناً شخصياً قوياً إلا أن التضامن لا يفترض، كما أن آثار التضامن على المدينين المتضامنين بعيدة المدى، وذلك نتيجة لطبيعته الخاصة. فالتضامن يقوم على تعدد الروابط ووحدة المحل، ويقوم من ثم المصلحة المشتركة فيما بين المدنين، وما ينتج عنها من نيابة تبادلية فيما بينهم.
فالتضامن يمثل مركزاً قانونياً معيناً. لكن تطور نظرية الالتزام، منذ زمن بعيد، قد أفرز نظاماً جديداً لا يقابل تماماً التضامن وإن كان يتشابه معه. هذا النظام الجديد هو ما يسمى الالتزام التضامني Lobligation in solidum. ويوجد الالتزام التضامني عندما يكون هناك شخصان أو أكثر ملتزمان بكل الدين في مواجهة الدائن، ويستطيع هذا الأخير أن يطالب أياً منهم بالدين كله بالرغم من عدم وجود مضامين فيها بينهم. لكن إذا كان الدائن يستطيع، في الالتزام التضامني، أن يرجع على أي من المدين ليطالبه بكل الدين، إلا أن هذه الديون، على الرغم من تماثلها، متميزة، كما أن هناك استقلالاً تاماً بين المدينين، مما يؤدي إلى انتفاء المصلحة المشتركة بينهم، ومن ثم استبعاد النيابة التبادلية فيما بينهم، على خلاف ما هو عليه الحال في التضامن. وهذا التضامن لا يفرضه اتفاق أو نص في القانون وإنما ينشأ من طبيعة الأشياء.
وللتعريف بفكرة هذا الالتزام وبنطاق تطبيقه جاء هذا الكتاب والذي يتوجه لطلاب الحقوق ولجميع العاملين في مجال الدراسات القانونية والذي يحتوي على دراسة تعريفية هدفها تحديد الأساس القانوني لهذا الالتزام التضامني، وكذلك تحديد نطاقه وآثاره وذلك لتبيان مدى قربه، أو بعده من التضامن السلبي.
