كان العالم طوال عدة قرون قد شهد صراعات عديدة حول مسألة السيادة على البحار تخللتها حروباً دامية بهدف التحكم في طرق الملاحة واستمر هذا الحال حتى قيام الحرب العالمية الثانية ومجئ ما يعرف بعصر التنظيم الدولي، لكن برغم ذلك فقد كان تحديد المركز القانوني اللمواقع المائية المشار إليها محل خلاف دائم بين الدول.
وقانون البحار أو القانون البحري هو مجموعة من القواعد والتشريعات والإتفاقيات تحدد المركز القانوني (حقوق و واجبات) للدول الساحلية المطلة على البحار والمحيطات أو المضايق والخلجان وحتى المياه الداخلية بما تتضمنه من أنهار وبحيرات وبحار مغلقة، وتنظم عملية الملاحة البحرية واستغلال الموارد الطبيعية والحية. وتعتبر اتفاقية الأمم المتحدة لقانون البحار لعام1982 هي أهم الإتفاقيات التي عنيت بمعظم تلك المسائل.
