يعتبر النشاط الفندقي ركيزة أساسية من ركائز السياحة ولذلك فهو يأخذ ذات أهميتها ويؤثر نفس تأثيرها. فالمنشآت الفندقية بما تؤديه من خدمات متنوعة سواء كمكان لإيواء النزلاء أو كافيتريا ومطعم للرواد، تلعب دوراً بارزاً في العمل السياحي، وللعلاقة القانونية بين صاحب الفندق والسائح أهمية تؤثر بالسلب أو الإيجاب في النشاط السياحي بما تولده من حقوق وإلتزامات متبادلة بين طرفيها بصرف النظر عن نوع ودرجة الفندق وقد كانت هذه العلاقة محل اهتمام كبير من تشريعات الدول المختلفة ومنذ زمن، وقد اهتم المشرع المصري بتنظيم العلاقة الفندقية أملاً منه في تشجيع صناعة السياحة وزيادة معدلاتها. فلم يكتف بما ورد في التقنين المدني من نصوص بشأن الوديعة الفندقية، بل تطرق إلى كل عناصر العلاقة في تشريعا خاصة، ونتناول في هذا البحث العلاقة بين الفندقي والعميل من حيث تحديد طبيعتها القانونية وبيان آثارها من خلال دراسة الإلتزامات الملقاة على عاتق أطرافها ثم معرفة المسئولية القانونية التي تنشأ بسبب الإخلال في تنفيذ هذه الإلتزامات وخاصة بالنسبة للفندقي، وذلك في أربعة فصول هي: (الفصل الأول: التنظيم التشريعي للعلاقة بين الفندقي والعميل، الفصل الثاني: التكييف القانوني للعلاقة بين الفندقي والعميل، الفصل الثالث: خصائص عقد الفندقة، الفصل الرابع: الآثار المترتبة على عقد الفندقة).
