على الرغم من بعض الاتجاهات الفقهية التى تنادى أن دعوى الالغاء كغيرها من الدعاوى مخصصة لحماية الحقوق الشخصية، وأنها تنتمى الى الشخصى ، أو أن ثمة عناصر شخصية تظهر فى دعوى الالغاء، وأن هذه الدعوى غيرت وجهها وأصبحت أكثر شخصية. فانه على الرغم من وجود هذه العناصر الشخصية، فان اختلاطها مع العناصر الموضوعية ليس من شأنه أن تؤدى الثانية الى استبعاد الاولى تماما، اذ فى الحقيقة فان دعوى الالغاء ليست مخصصة فقط لحماية مصالح شخصية خالصة، ولكنها بصفة خاصة لضمان تحقيق المشروعية.
وعلى هذا فانه وفقا للطريقة التى يفهم بها مجلس الدولة شرط المصلحة الشخصية، يتضح ما اذا كان قضاءه فى هذا الشأن مخصص بصفة أصلية لحماية الحقوق والمصالح الخاصة، أو على العكس. كوسيلة للرقابة، داخل المصلحة العامة لعدم المشروعية التى تقع من الادارة. لهذا كان شرط المصلحة فى قضاء دعوى الالغاء يحتاج الى أبحاث أكثر عمقا مما يحتاجه ذات الشرط فى قضاء آخر. من هنا كان الحافز لى على هذه الدراسة للاهمية البالغة لهذا الشرط.
وذلك وفقاً لخطة العمل الآتية: القسم الأول ونخصصه للمصلحة فى دعوى الالغاء- وهو ينقسم الى بابين- الباب الاول نتناول فيه شرط المصلحة فى الدعوى بصفة عامة، وفى الباب الثانى نتناول شرط المصلحة فى دعوى الالغاء،-والقسم الثانى- نخصصه للقضاء الادارى وشرط المصلحة فى دعوى الالغاء. وهو يتكون من أربعة أبواب. فى الباب الاول: نعالج طعون الافراد من غير الموظفين، وفى الباب الثانى: نتعرض لطعون الموظفين، وفى الباب الثالث: لطعون الجماعات، وأخيرا الباب الرابع: وهو خاص بالمصلحة فى الدعوى الدستورية.
