يعتبر هذا التعديل الذى نحن بصدده للدستور الفرنسي هو التعديل الرابع والعشرين على دستور الجمهورية الخامسة العائد إلى عام ألف وتسعمائة وثمانية وخمسين، وتعتبر الغالبية أن هذا التعديل يعزز من سلطات البرلمان، في الوقت الذي ترى فيه المعارضة أنه يضفي مزيداً من الطابع الرئاسي على النظام.
وقد تم التوقيع لصالح مشروع إصلاح الدستور الذي تقدمت به حكوة نيكولا ساركوزي، بعد أن تم دعوة (906) تسعمائة وستة برلمانياً للتصويت على هذا المشروع الذي إستغرق إعداده عدة أشهر.
وقد وافق النواب الفرنسيون على إقتراح رئيس الجمهورية نيكولا ساركوزي تعديل الدستور الفرنسي وذلك في جلسة إقتراع مشتركة عقدها فرساي بالقرب من العاصمة الفرنسية باريس.
وبعيداً عن المهاترات واللعبة السياسية التقليدية ما بين اليمين واليسار والسلطة والمعارضة، فإن نجاح ساركوزي والحكومة في تمرير الإصلاحات الدستورية التي طالت حوالي نصف مواد الدستور هو نجاح وفشل في وقت واحد بالنسبة له.
وسبب ذلك، أن ساركوزي فشل في تحقيق إجماع وطني وسياسي حول مشروع إصلاح الدستور وتحديث مؤسساته الرئيسية لأن اليسار رأى أن غرضها تقوية صلاحيات الرئيس على حساب المؤسسات الأخرى والإنتقال إلى نظام رئاسي.
ومن ثم فرغم الموافقة على هذه التعديلات وإقرارها إلا أنها لم تقر بالأغلبية المنشودة بل على العكس أغلبية هزيلة، هذه الأغلبية هي صوت واحد وكانت من جانب المعارضة، وأياً كان الموقف فما يهمنا هو أننا أمام تعديلات طالت ما يقرب من نصف مواد الدستور الفرنسي، وهذا ما سوف نسرده.
