تروم هذه الدراسة بيان حقيقة التوقف ومشروعية الاحتماء به عند الفقهاء، ورصد بواعثه، واستجلاء ضوابطه الكفيلة بتقييد مسلكه، وصونه عن شبهة التعطيل والتفصي من الأحكام، ذلك أن هذا المسلك الفقهي لم يظفر عند أهل الفقه والأصول بتأصيل محكم مستوفي، وكل ما كتب عنه لا يعدو اللمع المبعثرة، والتفاريق اليسيرة التي لا تشفي غليل الباحث، مما اضطرنا إلى توسيع دائرة البحث في مصنفات الفقه وشروح السنة، استقصاء لملامح هذا المسلك، وتجلية لصورته على نحو يشفي على المراد.
هذا وقد وزعت الدراسة إلى سبعة مباحث:
المبحث الأول: عني باستجلاء حقيقة التوقف، بدءاً من تعريفه، ومروراً ببدائله الاصطلاحية، وانتهاء إلى تمييزه عن السكوت لأمر عارض، ثم تراحبت بنا آفاق الدرس إلى بيان حكم التوقف وأضربه باعتبار موضوعه المعرفي.
المبحث الثاني: جلب نماذج من توقفات الأئمة الأربعة إيغالا في بيان حقيقة التوقف بأمثلة تطبيقية حية، وتأكيد على أنه مسلك محكم عند السلف، وليس بدعاً في باب الاجتهاد، مع العلم بأن أئمتنا متفاوتون في إعمال هذا المسلك والاحتماء به، فمنهم المقل والمستكثر.
المبحث الثالث: جلب صيغ التوقف التي يستفاد منها ترك القول في المسألة لالتباس وجه الحق فيها، وهي على ثلاثة أضرب: صيغة صريحة، وصيغة شبه صريحة، وصيغة محتملة.
المبحث الرابع: رصد أسباب التوقف ومثاراته، وهي تختلف باختلاف السياقات الاجتهادية، وطبيعة النوازل، ونوعية الإشكالات المنتصبة، ذلك أن لكل توقف باعثه المستقل، وسياقه المخصوص.
المبحث الخامس: عرض لخلاف أهل العلم حول مشروعية التوقف وجدواه، وساق أدلة المؤيدين والمعارضين، مع بيان وجه الاستدلال بها، وتعقبها أحياناً إذا لج الداعي، ثم صياغة ترجيح في المسألة معتضد بالنقل والعقل.
المبحث السادس: استقصى الضوابط العلمية للتوقف، وهي قمينة بتقييد مسلكه تقييداً يمنع التفصي من التكاليف، وتعطيل الشرائع، وانتقاء الأحكام من طريق الهوى والتشهي وموافقة الغرض.
المبحث السابع: سقى بدائل التوقف عند تعارض الأدلة، كالتخيير والتساقط والأخذ بالأحوط، وهي مسالك يؤثرها بعض الفقهاء على التوقف لعلة يركنون إليها.
