يضم هذا الكتاب بين طياته دراسة اهتمت بإلقاء الضوء على الشروط الاتفاقية في عقد الزواج، ما يقبل منها وما لا يقبل، ولا يخفى على القارئ مدى أهمية هذا الموضوع، حيث أن كثيراً ما تتنازل المرأة عن حقها مقابل الخلاص من شقاء وعذاب الزوج، انطلاقاً من هنا جاءت هذه الدراسة لتكشف للفتيات المقبلات على الزواج حكم هذا العقد ومدى توسع الشرع في الاشتراط فيه، وحكم الفقهاء في ذلك، كما وكشف الدراسة عن موقف القانون من هذه الشروط، وترد على سؤال هل استطاع القانون استيعاب الشروط في عقد الزواج؟
وهكذا اهتمت الدراسة أولاً ببيان مقصد الشارع من العقود، المشروعة فعرفت بالعقد لغة واصطلاحاً من ثم تناولت تكوين عقد الزواج وخصائصه وماهية الشروط الواجب توافرها لانعقاد وترتيب آثاره، ومدى حرية المتعاقدين في إنشاء العقود والشروط، من ثم توقفت عند رأي القانون من الشرط المقترنة بالعقد وسعت لإظهار أثر الشروط في عقد الزواج وأنواع الشروط، وفي مرحلة لاحقة توقفت الدراسة عن الاجتهادات التي تمسكت بمقتضى العقد ومزايا المذهب الحنبلي في سلطات الإرادة العقدية وأجرت دراسة مقارنة لأدلة الشروط في المذاهب الفقهية والأصولية والرد عليها، وأخيراً، توقفت وبشكل موسع عند حكم الشروط الاتفاقية في عقد الزواج فتحدثت عن أثر الشروط الاتفاقية لعقد الزواج وأهمية التوسع بها في وقتنا الحاضر، كما وتحدثت من قاعدة التعويض على الضرر وأنواع الأنكحة المشروطة الفاسدة.
