يتناول هذا الكتاب موضوع المقاصد الشرعية التي تعتبر القلب النابض للفكر الأصولي عند الإمام الشاطبي، فهي بمثابة العقل المحرِّك لكل مباحثه الأصولية، كما تعد أهم جديد أضافه الشاطبي إلى أصول التشريع الإسلامي، وقد مثلت المقاصد الشرعية الإطار الأصولي الذي حدد مسلك الشاطبي في تنظيره الأصولي في مختلف الأبواب والفصول، وإن كان الشاطبي قد حصر قسم المقاصد الشرعية في الجزء الثاني من كتابه الموافقات، إلا أن آثار التفكير المقاصدي في غيرها من المباحث الأصولية واضحة المعالم لا تخفى على قارئ مدقق.
فمقاصد الشريعة التي عني الشاطبي ببلورتها أصبحت عنده أصول قطعية حاكمة على النظر الاجتهادي وضابطة للعملية الاجتهادية نفسها، وينبغي التنبيه هنا إلى أن الشاطبي لم يكن بحثه منصبًّا فقط على بعث روح المقاصد وتطوير منهج البحث فيها، بل كان همه كذلك منصبًّا على مراجعة المادة الأصولية المدونة في مختلف الكتب الأصولية القديمة وإعادة النظر فيها تحقيقًا وتدقيقًا وتمحيصًا، وفي الوقت ذاته محاولة التنظير لمادة أصولية تكون متميزة في منهجها ومضمونها ومنتوجها، بحيث يظهر علم أصول الفقه في لبوس مقاصدي جديد يبعث على الحيوية ويدفع نحو التجدد والتجديد. وهذا المنظور العلمي والمسلك المقاصدي يتناسب في عصرنا في ظل التحديات الراهنة التي تعيشها الأمة، فاستحضار المنظور الأصولي المعاصر المشبع بمقاصد الشريعة يكتسي أهمية بالغة لما له من قيمة في فعالية التشريع الإسلامي في معالجة القضايا المعاصرة.
