Book Description
إن الشريعة الإسلامية قد اشتملت على أصول وفروع، ولكل منها علم قائم بذاته يرتبط بالآخر ويكمله. فعلم الأصول يبحث في الأدلة الشرعية، وفي طريق استنباط الأحكام منها، وهذه الأدلة منها المتفق عليها وهي أربعة: الكتاب، والسنة، والإجماع، والقياس، ومنها المختلف فيها، كالاستحسان والمصالح المرسلة وعمل أهل المدينة. وأما علم الفقه فموضوعه الأحكام الشرعية المتعلقة بأفعال المكلفين في العبادات والمعاملات ولذا سميت هذا الأحكام بالفروع لتفريعها من الأصول.
وقد اهتم العلماء بعلم أصول الفقه اهتماماً كبيراً، وبذلوا جهوداً معتبرة في ضبط مسائله وإحكام قواعده، فكان هذا العلم الأساس الذي بنيت عليه الأحكام الشرعية، وبفضل تلك القواعد والأصول انضبطت المناهج التي يلتزمها الفقهاء لاستنباط الأحكام من أدلتها التفصيلية.
ولقد كان عمل أهل المدينة من بين الأدلة التي اختلف فيها الأصوليون وثار حولها الجدل قديماً وحديثاً، والواقع أن أغلب ذلك الخلاف كان في غير محل النزاع، فكان هذا الموضوع خليقاً بأن يفرد بالبحث لكثرة ما بني عليه من الأحكام، من هذا المنطلق اختار المؤلف موضوعه هذا "عمل أهل المدينة وأثره في الفقه الإسلامي" ليكون موضع دراسة في كتابه هذا، محاولاً الاستفادة من جميع البحوث المتقدمة، والبحوث التي وضعت حول هذا الموضوع.
والغاية خدمة المذهب المالكي، وإحياء للتراث الفقهي المالكي، وإعادة كتابته في ثوب جديد يليق بمقامه بالإضافة إلى تقريب وجهات النظر حول هذا الأصل الفقهي، وتحرير محل النزاع فيه، إذ أن هناك مسائل كثيرة اعتمد فيها مالك رضي الله عنه على عمل أهل المدينة قد يخيل للبعض أنه يقدم فيها العمل على الحديث، وحقيقة الأمر ليست كذلك، وإنما مرد ذلك إلى تخصيص العموم أو تفسير النص بما فهمه السلف الصالح من الصحابة رضي الله عنهم.
