لا تخفى أهمية علم أصول الفقه بين العلوم الشرعية، فبواسطة قوانينه وقواعده يستطيع الفقيه إستنباط الأحكام الشرعية من الأدلة، ومعرفة حال المجتهد والمقلد، ويعود الفضل في تأسيس هذا العلم ووضع لبناته الأولى إلى الإمام محمد بن إدريس الشافعي (ت 204هـ)، ثم تواصلت عناية الفقهاء به على إختلاف أزمانهم وبلدانهم، فأسهموا بأوضاعهم وأبحاثهم في تطويره، حتى أضحى علماً ضابطاً لمناهج الإستنباط من الوحي، وأساساً للفتاوى الفرعية، وركيزة للإجتهاد والتخريج، وقانوناً للعقل والترجيح، فهو إذن ثمرة عقول أطالت النظر في هذه النصوص، وجَالَت بفكرها وفهمها في معانيها ودلالاتها.
وإظهاراً لعطاء علماء جهة عزيزة من بلادنا - وهي جهة سوس والصحراء - في خدمة علم أصول الفقه تصدّى الدكتور اِحيا الطالبي - أستاذ الفقه وأصوله بكلية الآداب بأكادير - إلى تأليف هذا الكتاب الذي يعتبر في أصله أطروحة جامعية نال بها شهادة الدكتوراه، وقد جلّى فيه كثيراً من مظاهر الإبداع والتجديد في أصول الفقه لدى علماء الجنوب المغربي.
كما عرّف الكاتب في هذا الكتاب القيم بمشاهير علماء الفقه والأصول، وذلك من خلال دراسة تحليلية لبعض المؤلفات الأصولية لهؤلاء الأعلام نثراً ونظماً، والوقوف من خلالها على مناهج التأليف الأصولي وأشكاله، ومسالك الإستنباط وأدلته، والإجتهاد والتقليد، وغير ذلك من مسائل هذا العلم مما أبدع فيه علماء هذه الجهة المباركة من هذا البلد الكريم.
