ربما قال قائل: إن موضوع المرأة قد هلك بحثاً، فهل من جديد في البحث والطرح؟! نقول: نعم، وإن كنا لا ندّعي أن هذا الكتاب سيكون الحكم الفصل في موضوع المرأة وتمكينها أكثر مما مكنها الدين، ولكن قد يكون الجديد فيه هو محاولة قراءة نصوص الفتاوى قراءة واعية، بعيدة عن التحيز، مع محاولة مناقشة مضمونها حول قضايا المرأة في إطار التغيرات والتحولات التي يمر بها مجتمعنا: إذ ليس كل القضايا لا يتم فهمها إلا من بوابة الفقه فقط؛ فالفقه علم كما باقي العلوم الإنسانية: إلا أنه يندرج تحت العلم الشرعي.
لذا من المهم إظهار بعده الإجتماعي بشكل واضح من خلال الوصل بين الديني والإجتماعي، ليتضح مفهوم المسؤولية الفردية تجاه المجتمع، فما أتى الدين إلا من أجل أن يحيا به الناس، ولم يأت ليحيا الناس من أجله.
والمرأة من الناس وهي مخاطبة بمفردة (الناس) التي تكررت الخطاب القرآني 190 مرة كالرجل، تماماً، وهذا يعني أنها مكلّفة ليس بتلقي الخطاب وحسب وإنما بفهمه وفقهه، حتى يتسنى لها إستيعاب مسألة الفصل بين الدين والسلوكيات المنبثقة من (لاوعي المجتمع).
والمتمثلة في رسائل رمزية سلبية، تظهر من خلال سلوكيات أفراد المجتمع وتعاملاتهم تجاه قضاياها، ذلك التعامل الذي أسسّه المجتمع الذكوري ضد المرأة ولم يؤسسّه الدين، حيث يختزن كل من الذكر والأنثى مخيالاً معيناً حول جنسها، تشبّعا به عبر الضخ الإجتماعي الكثيف الذي يصحبهما منذ الولادة، ويؤكد لهما على أن المرأة أداة لخدمة المشاريع العائلية والجسدية للذكر.
وهذا ما أشار له الفيلسوف الفرنسي "بيار بورديو" ضمن فكرة (رمزية العنف) التي تعني له: "ذلك العنف اللامحسوس واللامرئي من ضحاياه أنفسهم لكونه يمارس في جوهره بالطرق الرمزية للمعرفة أو الجهل أو العاطفة".
