حيث إن الشريعة الإسلامية جاءت لتنظيم حقوق العباد أفراداً وجماعات ودفعاً للمفاسد التي قد تلحق بهم تحقيقاً للمصالح وصيانةً للمقاصد العامة للتشريع، ونظراً لأهمية إثبات الحقوق التي من شأنها القضاء على أصل النزاعات والخلافات، فالشهادة إحدى الوسائل الكفيلة بذلك، وللشهود مكانة في الشريعة الإسلامية، حيث يتبين بهم الحق ويُرفع بهم الظلم.
